Besides swift settlement of damages, protection of your personal rights is an important concern for us. We therefore explain to you below which of your data we process and for which purposes, and your rights in this respect.

AVUS worldwide claims service GmbH & Co.KG acts as the responsible party within the meaning of the EU Basic Data Protection Regulation („DSGVO“).

Data processing: purpose and legal basis

We process your data in accordance with the relevant data protection provisions of the DSGVO and all other applicable laws. We process your personal data in order to comply with legal obligations, e.g. regulatory requirements, commercial and tax storage and verification obligations (Art. 6 Para. 1 c) DSGVO). We also process your data in order to protect our legitimate interests, or those of third parties, e.g. to guarantee IT security and IT operations (Art.6 Para.1 f) DSGVO).

Types of personal data recipients

Internal units:
Data may be transferred to internal staff involved in the execution of business processes (e.g. bookkeeping, accountancy, telecommunications and EDP).

External service providers:
In order to fulfil our contractual and legal obligations we also use external service providers, especially experts and lawyers.

 

Other recipients:
We may, furthermore, forward your data to other recipients, to the extent permitted by data protection law, e.g. to authorities to fulfil statutory notification obligations, to Green Card offices, compensation offices, information centres, etc..

Data storage duration

As a general rule, we delete your data as soon as they are no longer required for the afore-mentioned purposes, unless this conflicts with longer statutory storage obligations. Such obligations to provide evidence and to retain data arise from, among other things, the Austrian Commercial Code („UGB“) and the Federal Tax Code („BAO“).

Rights of affected persons

You can request information about your stored personal data and, furthermore, that it be corrected if incorrect or incomplete. Under certain circumstances you can request the deletion of your data. Finally, you may have a right to limit the processing of your data and a right to have the data provided by you surrendered in a structured, common and machine-readable format.

Right of objection

Whilst we will only process your data to safeguard legitimate interests, you may object to such processing for reasons stemming from your own particular circumstances pursuant to Art. 21 Para.1 DSGVO.

Gender neutral formulation
AVUS has refrained from using gender-neutral wording for some texts in the interest of clarity. Both genders are, nevertheless, always addressed within the meaning of equal treatment.
